1. Agreement to Terms

By accessing or using patchlynx.com or any related services operated by Patchlynx Inc. ("Patchlynx," "we," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Use of Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations;
• Attempt to probe, scan, or test the vulnerability of the Service, or breach its security measures, without written authorization from Patchlynx;
• Access or attempt to access data or accounts not belonging to you;
• Transmit any harmful, offensive, or disruptive content through the Service;
• Reverse engineer, decompile, or disassemble the Service except to the extent permitted by applicable law;
• Use automated tools to scrape or harvest data from the Service at a rate that adversely impacts its performance.

3. Intellectual Property

All content on patchlynx.com, including text, graphics, logos, software, and documentation, is the property of Patchlynx or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. No other license is granted.

If you submit feedback or suggestions to us, you grant Patchlynx a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.

4. User Content

You retain all rights to code, configuration, or data you submit through the Service ("User Content"). By submitting User Content, you grant Patchlynx a limited license to process that content for the purpose of providing the Service. We do not use User Content to train models or share it with third parties except as described in our Privacy Policy and as required to deliver the Service.

5. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PATCHLYNX DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Security analysis results are informational. They do not constitute a guarantee that your software is free from vulnerabilities. You remain solely responsible for evaluating and remediating risks in your own systems.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATCHLYNX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF PATCHLYNX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claim arising from or related to these Terms or the Service will not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim or (b) one hundred US dollars (USD $100).

7. Indemnification

You agree to indemnify, defend, and hold harmless Patchlynx and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with (a) your access to or use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.

8. Termination

Patchlynx may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, Patchlynx, or third parties. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be settled by binding arbitration administered under the rules of the American Arbitration Association in Washington, USA, except that either party may seek injunctive relief in any court of competent jurisdiction for claims involving intellectual property.

YOU AND PATCHLYNX WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
